Introduction
These Terms & Conditions govern your use of yadahahfreekah.com and any purchase, consultation, or bespoke commission undertaken with Yadah Ahfreekah Atelier (“the Atelier”, “we”, “us”).
By browsing this website, creating an account, booking a consultation, placing a ready-to-wear order, or commissioning bespoke work, you agree to these terms and to our published policies on privacy, returns, and shipping.
If you do not agree, please do not use the site or engage our services.
Definitions
In these terms:
- Atelier — Yadah Ahfreekah, a couture house based in Abuja, Nigeria, offering bespoke commissions and ready-to-wear for women of honor.
- Client — any person who uses the website, books a consultation, places an order, or commissions bespoke work.
- Bespoke Commission — a made-to-order garment created to the Client’s measurements and approved design.
- Ready-to-Wear (RTW) — finished garments offered for purchase from published collections or the shop, subject to availability.
- Consultation — a paid appointment at which measurements, design direction, and commission scope are established before bespoke work begins.
Consultations
Consultations are booked and paid in advance through the website or by arrangement with the Atelier. The consultation fee secures your appointment and is handled according to the policy stated at the time of booking.
During the consultation, the Atelier records measurements, discusses occasion, silhouette, fabric, and timeline, and establishes the direction for any bespoke commission. A consultation is required before bespoke production begins.
Missed appointments without reasonable notice may forfeit the consultation fee. Rescheduling is subject to availability.
Bespoke Commissions
Bespoke commissions are made to order for the Client’s measurements. Each piece is unique and cannot be resold or returned except where a verified manufacturing defect or damage is confirmed on delivery.
Timelines provided at consultation or in your commission agreement are estimates. Production may be affected by fabric sourcing, fitting schedules, complexity of construction, or events beyond our reasonable control.
Payment follows the Atelier’s bespoke schedule: 60% deposit to commence work, 25% after the first fitting, and 15% before dispatch. Work does not proceed to the next stage until the applicable payment is received.
The Client must approve designs, fabrics, and key construction decisions before production. Delays in Client responses — including fitting attendance, approvals, or payment — may extend the completion date accordingly.
Pricing & Payment
Prices are quoted in Nigerian Naira (NGN) and/or United States Dollars (USD) as displayed at checkout or in your commission agreement. Currency and final amounts are confirmed before payment.
We accept payment via Paystack, Flutterwave, bank transfer, and other methods made available on the site. Card payments are processed by PCI-compliant third-party providers; the Atelier does not store full card details.
Deposits and consultation fees are non-refundable once work has commenced or materials have been ordered for your commission. Partial payments already made toward a bespoke commission are applied to work completed to date.
Fittings & Alterations
Bespoke commissions include fittings as agreed in your commission schedule. The Client is responsible for attending fittings at the agreed times or arranging alternatives with the Atelier.
Minor alterations within the original approved design are included where stated in your commission agreement. Substantial design changes after approval may incur additional charges and timeline adjustments.
Failure to attend scheduled fittings may affect fit and finish; the Atelier is not liable for fit issues arising from missed fittings or inaccurate measurements supplied by the Client.
Ready-to-Wear Orders
Ready-to-wear orders are accepted subject to stock availability. We reserve the right to decline or cancel an order if an item is unavailable, if pricing was displayed in error, or if we suspect fraudulent activity.
Displayed prices include applicable taxes where stated. Shipping costs are calculated at checkout in accordance with our Shipping Policy.
Ownership of RTW goods passes to the Client upon full payment and dispatch. Risk passes upon delivery to the carrier or Client collection, as applicable.
Intellectual Property
All designs, sketches, patterns, technical drawings, lookbook imagery, and website content remain the intellectual property of Yadah Ahfreekah Atelier unless otherwise agreed in writing.
Clients may not reproduce, copy, reverse-engineer, or commercially exploit Atelier designs or illustrations. Commissioned garments are for the Client’s personal use unless a separate licensing agreement is executed.
Cancellations
Bespoke commission cancellations after work has begun forfeit the deposit and any payments attributable to work already completed or materials procured.
Ready-to-wear orders may be cancelled before dispatch by contacting the Atelier promptly. Once dispatched, cancellations are handled under our Exchange & Returns Policy.
The Atelier may cancel a commission or order with a full refund where we are unable to fulfil it; we will notify you as soon as practicable.
Limitation of Liability
To the fullest extent permitted by law, the Atelier’s liability for any claim arising from these terms, the website, or our services is limited to the amount paid by the Client for the specific order or commission giving rise to the claim.
We are not liable for indirect, consequential, or special losses, including loss of profit, loss of opportunity, or emotional distress, except where such limitation is prohibited by applicable law.
Nothing in these terms excludes liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under Nigerian law.
Governing Law
These terms are governed by the laws of the Federal Republic of Nigeria. Any dispute arising from or relating to these terms or our services shall be subject to the exclusive jurisdiction of the courts of Nigeria, unless otherwise required by mandatory consumer protection provisions.
